CITY REGULATION AND CERTIFICATION OF TOUR GUIDES
On April 3, 2008, the Philadelphia City Council enacted Ordinance 080024-A amending Chapter 9-200 of the Philadelphia Code, entitled "Commercial Activities on
Streets,” by adding a new section providing for the certification of tour guides in certain areas of the city, establishing requirements for such certification, and providing for penalties for violations, all under certain terms and conditions. This ordinance was initially scheduled to go into effect October 13, 2008.

Following a suit in federal court challenging the constitutionality of Ordinance 080024-A, a federal judge suspended the ordinance for six months until certain issues had been worked out. That moratorium on the law expired in April 2009.
The federal judge dismissed the lawsuit raised by guides, citing the city's inability to enforce the ordinance. Should the city attempt to enforce the ordinance, then the issue would be revisited and a ruling on the ordinance's constitutionality.
